General Terms of Service for EWT Investing.com services.

These terms of service apply from 2023-02-23 and indefinitely into the future, unless superseded by new updates later on. These terms apply to all types of customers & clients, both private and business clients, that are subscribed to the GEWC subscription service. The use of the terms “we” or “our” or “us” in the document denotes EWT Investing and all its personnel. In the text, the terms “membership”, “service(s)” and “subscription” and “contract” and derivatives of these words, refer to the same thing, i.e. the services we offer.


 

1. Payment & Contract terms and conditions.

1.1.1 Payment processing.
When a client chooses to sign up for a subscription through our site, he/she will if they choose any means of direct payment settlement, engage the payment system of one of our payment processors (Stripe – no affiliation implied by them being mentioned here). All payment processing is made through the payment processor’s infrastructure, with the exception of some user data that is securely (and not visible to us) transmitted to the payment processor. The exact process will differ depending on which payment processor the customer chooses at checkout.
Should the client choose offline bank payment, the client will be furnished with payment details by us by means of electronic communication (typically an email). The clearing of the payment will in that case be handled by the bank(s) involved in the transaction. Upon receipt of the funds, we will manually activate the services and/or products the client ordered and paid for. This process is not automatic, and can take several business days to complete in full when considering the typical delays in payment clearance and transfers between banks internationally.
Our site is protected by several different security layers and uses Force SSL on every page to ensure that all communication between the server and the user is secured. The SSL certificates we use are RSA 2048 bits. Should the customer have any doubt as to the strength of our SSL certificates, we recommend that the customer vists an online SSL tester and types in our domain name (ewtinvesting.com), and take a look at the result for him-/herself.

1.1.2 Payment problems/error handling.
EWT Investing cannot be held responsible for any payment error that occurs as a result of any type of failure with one of our payment processors as the payment process occurs out of our reach.
However, we will of course assist the customer with any problem that might arise during the payment process, for whatever reason, to the extent we are liable to do so. The customer is advised to please contact us immediately if something goes wrong during the process and it is not evident from any displayed error messages what needs to be done on the customer’s end to rectify the situation.

1.2 Payment of the subscription cost.
The entirety of the subscription cost must be paid in one payment installation. The payment cannot be divided into parts.
If the payment has not been received in due time, the system will automatically disallow access to the membership areas of the website.
If you have made a payment, but somehow cannot access the website, please contact us immediately, and we will assist in resolving the issue. Please note that if you chose to pay using an offline means such as a transfer to our bank account, there will be a delay of possibly several business days in total, before the funds have reached us and we can proceed with manually activating your account.

1.3 Recurring billing.
The customer must pay the subscription cost for any started subscription period at the start of each period. Hence, if using the option to pay with a credit card, a payment from the customer’s credit card to us through our payment processor is initiated at the start of each new subscription period (i.e. weekly, monthly, quarterly, yearly). When the membership system detects that the payment has been successfully completed, the subscription information in our database is automatically updated to reflect that the customer has paid for one more subscription period and access to the service is renewed/allowed.
If using offline payment through bank transfers, the process is slightly different and involves us notifying the client with payment details so that the client may perform the payment process on his end in due time to maintain the subscription service, should the client choose to do so.

1.4 Information about EWT Investing on the bill.
Depending on the customer’s bank, and their way of showing to whom the customer made a payment, there are a few possible items that may appear on the customer’s credit card statement: 1. We conduct business under the name EWT Investing, which is fully owned by JMF, registered in Sweden. Shorthands of either of these two names may appear. 2. Our payment processor is Stripe. Shorthand or full name of the payment processor may also appear. It is possible that the customer credit card statement contains combinations of the above mentioned company and business names. The customer is always welcome to contact us if for any reason, he/she needs an extra receipt with our full legal business names. We are registered for tax purposes and VAT in Sweden.

1.5 Refunds are not possible.
Refunds – for any reason – for this kind of product (electronic content that can easily be duplicated) is something we are allowed to refuse to issue under Swedish law, irrespective of if the client is a private individual or a corporate or business entity. Normally, corporate  and business clients are also excluded from refunds under Swedish law. Hence, we reserve the right to out of hand dismiss any and all requests for refunds for our products and services.
Service delays and reductions on our part due to staff illness, will be settled primarily by subscription service extensions for the affected client(s). See more details on this in sections 6.5 and 6.6 further down in this document.

1.6 Contract duration.
Contract durations are determined by the contract length selected by the client, and they start after we have received the payment and thus activated the membership for the client. The duration of the membership is only for as long as the client has paid us for.
In the case of another client performing a “buy-out” of our services (i.e. exclusively purchasing our services for their use), the client will receive our full services for the remaining duration of their paid-for contract, or if circumstances force it, the client will be issued a refund equivalent to no less than the remaining amount of days on their already paid-for contract.


2. Market data delivery and external suppliers of market data.

Our external suppliers of financial market data for any and all symbols, stock market indices, bond markets, commodities or currencies (including pairs and indicies) cannot be held reponsible for the analysis we do, using the data they have supplied to us. We add markings, letters, numbers, and sometimes text to the charts, and these additions constitute only our opinion, and is in no way something the data suppliers can be held liable for.

Charts with any and all types of analysis created by EWT Investing, are copyright protected automatically, with us being the holders of said copyright.

We want to point out that it is possible that the delivery of necessary data for our analysis work may cease – such an event is beyond our control, and constitutes a Force Majeure event in addition to the events listed in the separate Force Majeure-part of this document, for which we cannot be held liable. Naturally however, we will strive to immediately replace a possibly lost data supplier as soon as possible, and there is no advantage at all for us in not being able to deliver analysis to our customers. The customer will agree that we are given given 7 business days to replace any lost data supply and resume analysis updates.


 

3. Possible webhosting & tele-communications issues.

The customer will agree that any and all issues with our webhost which prevents analysis updates from being published on time, and/or which disables access to our website(s) constitutes a Force Majeure event for which we cannot in any way be held liable. Such events have historically been very, very rare occurences.
Similarly, if we experience a full telecommunications failure, it will be impossible for us to conduct business as usual during the duration of said failure. The client agrees that this constitutes a Force Majeure event for which we cannot in any way be held liable. Complete telecommunications outages have historically been very rare occurences for us.


4. Sharing of intellectual property & other data from EWT Investing.

Sharing of any intellectual property intended for subscribers and clients only, is strictly prohibited.
The subscriber agrees that any unauthorized sharing of our products (i.e. analyses including charts and graphics) constitutes a serious breach of contract for which the client  at a minimum agrees to pay financial damage to us to begin to compensate. The damages awarded to us will be in proportion to the potential economic loss we suffer from the breach of these Terms of Service.
Data can however be shared within corporate entities that have purchased our services, as it is almost always the case that several people make use of analysis products of this nature. Such sharing or our analysis product(s) within a corporate entity that has lawfully purchased access to them from us, shall not constitute a breach of the Terms of Service.
Sharing data with other entities, be they private individuals or other corporate entities is forbidden and constitutes a breach of the Terms of Service for which the client agrees to at a minimum pay financial damages to us to begin to compensate. The damages awarded to us will be in proportion to the potential economic loss we suffer from the breach of these Terms of Service.


5. General information about trading with any and all financial instruments, stocks, futures contracts, currency units, and any and all derivates of all of the aforementioned.

We – EWT Investing – want to draw the customers/clients/subscribers/members attention to certain aspects of trading with any and all types of financial instruments, including but not limited to stocks, futures contracts, currency units, and any and all derivates of all of the aforementioned – all of which are henceforth in this document encapsulated by the term “financial instrument(s)”.
I. Trading with financial instruments of any sort always involves taking on risk. There are absolutely no guarantees that your investment capital will either increase, decrease or remain unchanged over any period of time.
II. We would disencourage the reader from thinking of financial instruments as “savings”, because they are a lot riskier than for instance, physical cash or a non-locked cash account at a bank. And even those two types of positions do carry risk with them.
III. We recommend – in general – that you never invest any capital you cannot afford to lose.
IV. We recommend any reader to consult with a proper, legally certified financial consultant, to properly ascertain and evaluate his/her risk level before taking on debt.
V. We recommend that the reader always makes sure to keep himself/herself up-to-date regarding all applicable taxes, commissions and other fees that might apply to his/her account and/or trading activities.

6. Other Terms & Conditions.

6.1 Age of the subscriber/member/user/reader.
In order to sign up for a subscription/membership with EWT Investing, you must be at least 18 years old, derived from Swedish adulthood age. If you sign up for a subscription or membership with us, you automatically confirm by accepting these terms and conditions, that you are at least 18 years old and that you are legally considered to be an adult (i.e. not legally stripped of your adulthood status).
We do not assume *any* responsibility for *any* trading or investment decision whatsoever which is made using any information, statement, or analysis issued by us, and this applies regardless of the subscriber’s age and legal status.

6.2 Intended type of client.
The intended clients for any of our products and services are not private citizens. In general, EWT Investing does not hold out its services to private citizens (although some select products have historically been intended also for private clients, and such products may be made available again at a later date), but rather to corporate clients.
If any products we provide happen to actually be geared towards private citizens as well, this will be specified in the additional terms of service specific to that particular product, and will if so supersede section 6.2 (this section) of these General Terms of Service for our products and services.

6.3 Usage of customer/subscriber/member personal data.
Customer data such as name, address, email address are stored in our database in compliance with GDPR regulations (for example, book keeping). Customer credit card info is never, ever stored at our systems, and is processed by our external payment processors. All such data, indeed all data on the entire site, is transmitted only through SSL.
Customer data is never sent/passed on/sold/given or otherwise transmitted to a third party, unless a certain third party has a lawful right to receive the data (such as certain government agencies or actors involved in lawful legal investigations).

6.4 Support.
EWT Investing only provides support by email at present. Please contact us through the form at this page – https://ewtinvesting.com/contact-us/ – if you need assistance with any technical matter, payment questions or general questions regarding the services we offer. We do not provide any maximum response time, but we attempt to resolve any questions quickly.

6.5 Sickness leave.
If our staff is stricken by any type of sickness which prevents the regular analysis updates from being resolved, we will strive to notify the readers of this situation immediately.  The client agrees that an adverese health outcome requiring rest and convalescence shall not constitute a breach of these terms of service. Compensation for any delays or missed analysis updates will be worked out once good health has returned and work can be resumed, with the client agreeing beforehand (through acceptance of these terms of service) that subscription extension is the primary method of settling any illness-related service interruptions.

6.6 Vacation leave and holidays.
We follow Sweden’s public holiday schedule, and reserve the right to take any such holiday off without compensation being issued to the members.
If we go on vacation leave, the site will remain open to clients, but any active subscriptions that will temporally overlap with our vacation leave, will be compensated with 1 extra day of subscription added for free from our side, per every 1 day of vacation that we take. We will notify the client as far out as is possible of any planned future vacation leave.

6.7 Time of analysis updates.
There is no specific time of day when analysis updates are issued and published. This is due to the fact that each trading day is different, and thus presents a differing workload and differing amounts of information to consider before and during analysis updates.

6.8 Transfer or sale of the company or some or all of its assets.
In case the company is sold to another party, we will notify the customer of this well in advance. Any outstanding period of a subscription that a customer has paid for, shall be refunded if the customer wishes to terminate his or her subscription under these circumstances.

6.9 Changes to these Terms & Conditions.
The terms and conditions on this page can be changed by EWT Investing with a 15-day warning period. However, if any changes to these Terms & Conditions on this page occur, despite the 15-day warning period, we are still obliged to follow legal guidlines on having served appropriate notice to any and all affected parties.

6.10 Third party errors & problems & Force Majeure.
Aside from any clauses mentioned above, EWT Investing and any and all of its personnel in any capacity, are never to be held liable for any interruption, denial of service (typically of our webhost), interruption of services (including a telecommunications blackout), errors, damages and other problems of any sort that are beyond our control, including but not limited to lightning strikes, flash floods, fires, strikes and union-related as well as non-union-related lockouts, war, acts of war, acts of terrorism, disruptive criminal activity of any sort, Internet overload and Denial of Service or malware attacks, all types of errors in third party networks, errors and problems at a third party, system server crashes caused by webhost negligence/malpractice/general error, and any and all other Force Majeure-types of incidents.

6.11 Laws and Courts.
A possible legal dispute is to be solved primarily at a Swedish court of law according to Swedish law.

6.12 Intellectual Property Rights Provisions.
This website and all of its original content, features, and functionality are owned by EWT Investing and its owners, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.13 Termination Clause.
We may terminate your access to the service in accordance with non-payment or due to legal matters, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of our liability.
